1. Reimbursement of accommodation cancellation expenses
1. The guarantee relating to trip cancellation expenses is the one described in this article. It shall be valid from the moment the Company receives notification of the insured person’s inclusion from the Policyholder, and shall end at the time of arrival at the insured establishment (apartment). This guarantee shall not be valid unless it is taken out at the same time as the trip being insured.
2. The Company shall reimburse the accommodation cancellation expenses (hotel, rural accommodation or apartment) incurred by the Insured and invoiced to them in accordance with the general sales conditions of the supplier, provided that the trip is cancelled before its start and for one of the following reasons:
a) Serious illness or bodily accident, or death, of:
• The Insured, or their spouse, children, parents, grandparents, siblings, parents-in-law, sons-/daughters-in-law and brothers-/sisters-in-law.
• The person who, during the trip, is responsible for looking after the Insured’s minor or disabled children at their usual residence.
• The Insured’s professional replacement, provided that it is essential for the Insured to assume the position or responsibility.
b) Being summoned, as a party, witness or juror, by a court, provided that this was not known prior to the purchase of the trip. An original copy of the judicial or administrative summons must be provided.
c) Serious damage caused by fire, explosion, burglary or natural forces at the Insured’s main or second residence, or at their own or rented professional premises, rendering them uninhabitable or involving a serious risk of further damage that makes the Insured’s presence absolutely necessary.
d) Non-disciplinary dismissal of the Insured. In any case, the policy must have been taken out prior to notification of dismissal by the employer.
e) Cancellation by the person who was to accompany the Insured on the trip, provided that such person was registered at the same time as the Insured and is insured under the same contract, and that the cancellation is due to one of the causes listed above. If the Insured decides to travel alone, the additional costs corresponding to a single-room supplement shall be covered.
f) Taking up employment with a different company under an employment contract, provided that the start date is after joining the insurance and that the Insured was unaware of this at the time of taking out the insurance.
g) Being called to sit official competitive examinations, with notice received after joining the insurance.
h) Acts of air, land or sea piracy that prevent the Insured from starting the insured trip.
i) Theft of documentation or luggage that prevents the Insured from starting the trip, provided that it occurs at their home within 48 hours prior to the start of the trip.
j) Becoming aware, after booking the accommodation, of the obligation to file an amended personal income tax return, with an amount payable exceeding €600.
k) Placement of a child for adoption.
l) Refusal of visas for unjustified reasons.
m) Compulsory work relocation for a period exceeding three months.
n) Unexpected call to undergo surgery.
o) Medical quarantine.
p) Declaration of a disaster area at the Insured’s place of residence or at the trip destination.
q) Winning accommodation similar to that booked in a public draw certified by a notary.
r) Police detention of the Insured for non-criminal reasons.
s) Mental or psychiatric illnesses requiring hospitalisation or institutionalisation.
t) Being called to serve as a member of an electoral polling station.
u) Judicial declaration of suspension of payments or bankruptcy of the company.
The Insured is obliged, in accordance with Article 17 of the Insurance Contract Act and Article 9.4 a) of Law 21/1995 on Package Travel, to use all reasonable means to reduce the loss and to notify the travel provider or the Company of the cancellation as soon as they become aware of the event causing it. Failure to comply with this obligation shall entitle the insurer to reduce its benefit proportionally, paying the Insured only the amount corresponding to the cancellation expenses that would have been payable on the date the event causing the cancellation became known, in accordance with Article 9.4 a) of Law 21/1995 regulating Package Travel.
To claim compensation under this guarantee, the Insured must submit the following documents:
1. Copy of the document evidencing the occurrence of the loss (medical report or death certificate, fire brigade report, police report, insurance company report, etc.). This
document must necessarily state the date of the event (hospitalisation, death, loss), the diagnosis or type of damage, medical history or previous conditions, and the prescribed treatment.
2. Original invoice and/or payment receipts for the trip, and a copy of the travel voucher issued by the agency.
3. Copy or photocopy of the cancellation charges invoice issued by the service provider, and a copy of the general sales conditions.
4. Original cancellation document issued by the travel agency, together with the cancellation charges invoice or credit note.
Specific exclusions for this guarantee
a) Aesthetic treatment, cures, travel or vaccination contraindications, or the impossibility of continuing preventive medical treatment recommended for certain destinations. b) Epidemics. c) Failure, for any reason, to present essential travel documents such as passport, visa, tickets, national identity document or vaccination certificates. d) Non-urgent dental treatments and rehabilitation treatments. e) Pre-existing illnesses, provided that they manifested during the 25 days prior to taking out the insurance. f) Voluntary decision not to travel. g) Failure to comply with official prohibitions of any kind. h) Contract extensions, changes to leave permits, or failure to pass probationary periods. i) Trips booked more than three days prior to taking out the insurance.
Maximum compensation per person: For this policy, the maximum compensation per person in the event of a claim is set at €2,000.
